Posted on Thursday 16th January 2014

Published in Medical Law Review this month, Mrs Kirsty Moreton, Teaching Associate at Birmingham Law School critiques Professor Jonathan Herring's new book Caring and the Law (2013, Hart Publishing).

With care ethics experiencing a resurgence of interest in the realm of healthcare law and policy, this review examines Herring's claim that ‘caring is an essential aspect of human existence’ (p2), which holds great potential as the basis for a reconstruction of social and legal thinking and practice. It explores Herring's theoretical construction of an ethic of care and assesses the success of its practical application to concrete legal scenarios.
