Module description

In this module, we will explore and critically examine how international and domestic human rights law affects various stages of the criminal justice process. We will also consider whether human rights law should have any bearing on the criminal justice process.



We will consider the following topics: the rights of suspects at the pre-trial stage of the criminal justice system; the right to a fair trial; rights in relation to sentencing and punishment; the rights of prisoners, and the right to redress in cases of miscarriages of justice. You will be expected to learn how human rights work in the criminal justice system, and to form an opinion on the extent to which they should affect the criminal justice process.
