This talk considers the changes in the UK regulators’ operational framework for conducting supervision that took place in the wake of the 2008 financial crisis. It charts the origins of that shift in approach, considers the changes to statutory powers for regulators flowing from it. In addition, it raises some practical issues for lawyers to consider in relation to use of those powers especially in an enforcement and intervention context.
