Birmingham Law School is delighted to see that Professor Nelson Enonchong’s impactful book on Duress, Undue Influence and Unconscionable Dealing continues to influence the development and application of the law by senior courts in the UK and internationally.
In the recent case of Takhar v Gracefield Developments Ltd [2024] EWHC 1714 (Ch) the High Court of England & Wales drew on the analyses in numerous paragraphs of the book in reaching its conclusions on some important legal points concerning the law of undue influence. At the outset of the court’s discussion of these points, the learned judge referred to “Professor Enonchong's excellent work 'Duress, Undue Influence and Unconscionable Dealing' (2023) 4th Edition (to which I return repeatedly below).” Indeed, the learned judge returned to the book 18 times, citing several paragraphs in five different chapters.
